Auction Terms & Conditions AUCTION TERMS & CONDITIONS: A Buyer's participation in this auction is an acknowledgement and acceptance to all Terms & Conditions outlined, along with the protocols outlined in the Bidding and Auction Notices for Two Five Auction.
BUYER PREMIUM: Buyer Premium of 10% plus Ontario HST will be applied to each invoice for all winning Bids.
ALL SALES ARE FINAL. NO REFUNDS, NO EXCHANGES, ALL ITEMS SOLD AS IS WHERE IS. WITH NO WARRANTY. Please note details in the Lot descriptions, we have consignors that list both new and used merchandise. There are no real or implied warranties on any items; everything is "SOLD AS IS."
REVIEWING YOUR BIDS: During an active auction you can check the status of your bids at any time. Note that no bids can be withdrawn after the auction for any reason. All items are sold as is, where is, with any deficiencies.
BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. The method and procedure of any auction on the Website is at the sole discretion of Two Five Auction. By placing an online bid, Buyers agree that they are satisfied with description and photos, and/or have waived rights to inspect further. Two Five Auction reserves the right to reject any bid, at any time and without reason or explanation.
WINNING NOTIFICATION & INVOICING: All winning bidders will receive an e-mail with an attached invoice from Two Five Auction the morning following the auction close and have 48hrs to send etransfer.
PAYMENT FOR YOUR ITEMS: There is no cost to register for an auction. When an auction closes, you will be notified if you are the winner. We will request an e-transfer payment for balance owed; winning bid amount, plus applicable Buyers Premium and taxes, as stated in terms of auction. Payments are accepted exclusively through e-transfer. Cash and Credit NOT accepted at this time. Items not paid for in full, claimed, or picked up, in accordance with the terms and conditions of sale and within 2 days of the event's conclusion, will be considered abandoned and resold in a future auction sale without notice. Any deposits on hand will be forfeited and non-complying buyers/bidders will be blacklisted on future auction sales. All items must be paid for within 2days of auction ending.
PICK UP SCHEDULE: Purchases will only be dispensed when proof of paid invoice is provided. The winning bidders are responsible for arranging and adhering to agreed pick-up time. We do not ship. Do not bid if you are unable to have your items picked up during our designated dates and times. Pick up times for this auction are; Sunday October 25th 12-6, and Monday October 26th 3-9pm We will be coordinating deliveries with a third party company for Wednesday October 28th. Delivery option within GTA has a $15 fee. Please email us with your preferred time slots for pick up or choose to opt in for delivery on Wednesday!
In order, to maintain social distancing procedures, please call us to verify specific pick up window time. Curbside Pick-up is available at 3136 Mavis Rd, Mississauga & 40 Carl Hall Rd Toronto
Pick up for the items shall be at the expense, liability, and risk of the purchaser. Please note that there will be no support staff available to help transport items to your vehicle. It is recommended that you bring help if you purchased large or heavy items. Upon delivery, we are not responsible for items that were forgotten or left behind. Be sure to verify all items before you leave pick up area. The purchaser will not be entitled to possession of any Lot purchased from Two Five Auction until the total purchase price of the Lot, any other items and any outstanding invoices (due to Two Five Auctions) have been fully paid. In the event that Buyers fail to pay the full purchased price for any lot(s) within the prescribed time, or fail to comply with any of the "Terms of Sale", they may be sent to collections and/or sued in the Small Claims Court. In addition, any paid amount for previous invoices and Lots (by the purchaser and not in their possession) will be treated as a deposit towards outstanding invoices without notice. If Buyer abandons or fails to pick up during the specified times, Two Five Auctions shall not be held responsible and shall add a surcharge of $25 added to cost and/or sell to recover storage costs.
PICK UP PROCEDURES: Due to Covid restrictions Please adhere to social distancing protocols and wait until one buyer leaves before coming up to pick up area. PLEASE MAKE SURE YOU HAVE ALL YOUR ITEMS BEFORE YOU LEAVE.

CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: Two Five Auction certifies that our best efforts are exercised to represent all items accurately in descriptions and photographs; however, all items are ultimately sold in 'as is, where is' basis, with deficienciesif any. No responsibility is assumed by Two Five Auction or the seller for any errors or omissions. Please observe all photos carefully and read descriptions thoroughly before you place your bids.
Two Five Auction and its consignors make no representations or warranties as to the accuracy of its catalogue or other descriptions regarding the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation or assumption or liability. We and the consignors are not responsible for errors and omissions in any catalogue or any supplemental material. We do not guarantee, any written or oral appraisals, certificates of authenticity, values, or retail replacement prices, that may accompany any item or may be orally stated by any auctioneer or employee, before, after and during any auction sale.
CLAIMS: No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold in 'as is, & where is' basis, with all potential deficiencies. By registering, Bidders acknowledge and understand that all sellers and consignors shall not be liable for any direct, indirect, and/or incidental, damages to any individual or their property. Two Five Auction nor its sellers/consignors shall be held liable for any personal and/or property damage that may occur on premises during events and/or pick up time.
PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property.
ADDITIONS & DELETIONS: We reserve the right to withdraw and/or add lots and/or items to the sale at any point during the auction.
BUYERS: The BUYER expressly agrees to indemnify and ensure, the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions Two Five Auction, or anyone acting in his/her behalf in connection with or arising out of auction. All bidders/buyers must be of legal age.
RESERVE: If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', Buyers will be required to pay a minimum amount in order, to secure the item. All items that are offered by auction may be subject to a reserve or opening bid, which is the confidential minimum price acceptable to the sellers.
AUCTION RECORDS: In the unlikely event of a dispute, Buyers agree to accept the information that we have in our records, as the legitimate transcript & confirmation. The highest bidder acknowledged by Two Five Auction will be the purchaser. In the event of any dispute between bidders or in the event of doubt on our part as to the validity of any bid, we will have the final discretion to determine the successful bidder, cancel the sale or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales record is conclusive.
SOFT CLOSE: Items close at regular intervals. To prevent a bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 3 minutes. This will continue until all bidding has ceased. Most of our auction lots close in 10 second intervals. In other words, if an auction has 100 lots and is scheduled to close at 8:00 p.m., the first lot will close at 8:00 pm (soft close in effect) while the 100th lot will close at approx. 9:16 p.m. (soft close in effect).
STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.
CATALOGUE ERRORS & OMISSIONS: Written and oral descriptions are the opinions of the Two Five Auction and/or the consignors, and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. Two Five Auction believes to the best of its knowledge that the information presented in any auction has come from reliable sources. However, such information is presented solely for the convenience of the prospective purchasers. Two Five Auctions attempt to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the accuracy of the catalog or other descriptions of the lot. It is the responsibility of prospective bidders to examine all items in which they have an interest. By placing a bid, in any capacity, you signify that you have examined the items as fully as you desire and have had the opportunity to ask questions and receive answers from Two Five Auction that you deem adequate. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, do not bid on the Lot in question. If a description does not match a picture in a lot, the description takes precedence. All items are sold in 'as is, where is' basis, with all and any deficiencies.

By registering for this auction, you are opting in to receive auction notices from Two Five Auction. You may withdraw your consent at any time by clicking on the unsubscribe link contained within each auction notice. Your privacy is important to us -- your email address will not be shared with any other party. You acknowledge that Two Five Auction may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Two Five Auction, Site users, and the public.
ELECTRONIC COMMUNICATIONS: Buyers agree to electronic communication for all transactions and communication with Two Five Auction and the Website. Buyers agree that all postings, notices, disclosures, or other communications that we provide electronically satisfy any legal requirements that such communications be in writing.
