Description
Downsizing of multiple homes with household contents and more. Pickup will be on Friday July 30, 2021 between 10am and 7pm at 190 Ranchers Road Payments by Cash, Cheque or Money Transfer only.
REGISTRATION & IDENTIFICATION: At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. All bidders must be of legal age to bid. By registering you agree to receive emails sent to registered bidders for the auction you register for. Registered bidders are not able to opt out of these emails but you will only receive emails for the auction you registered for or any related auctions. You may opt out of general emails by clicking on the "Unsubscribe" link found at the bottom of the email. If the link is not at the bottom, it is an email you cannot unsubscribe from. You give your consent to receive these particular emails by registering. PAYING FOR YOUR PURCHASES: There is no cost to register for an auction (Up to $1 may be charged to validate your card by Auctionflex the first time you register). Your credit card will not be charged unless you win and do not pay within the pick up period. When an auction closes, if you are the winner, you must attend during the allotted pick up time frame where you may pay EXACT cash, Visa, Mastercard or Debit (card must be physically present and pin used). We will not charge cards over the phone, online or entered manually). We DO NOT accept etransfers, certified cheques or money orders. If you do not pick up during the allotted time, we will charge your card a 25% restocking fee (or $20, whichever is greater), your items will NOT be held for you and your account will be suspended. There will be a $50 admin fee to reinstate your account. By registering, you give Drop The Hammer Auction Services permission to charge these fees to the credit card you have registered with. If we are unable to charge the restocking fee the amount will be reported to the Credit Bureau. To reinstate your account there will be a $100 admin fee plus the outstanding restocking fee and BUYERS PREMIUM AND HST: ALL items will be charged a 15% Buyer's Premium and 13% HST REGARDLESS of the item. If an item is in any part tax exempt, bidders may keep their invoice and claim the exemption on their income tax. Full buyer's premium and full HST will be charged on all items. Bidders should factor this into their bid price. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after they are placed for any reason including accidental bids and bidding on the wrong item. Be careful when bidding, ensure you have selected the correct item before clicking "bid". All items are sold as is, where is, with all faults with no guarantees that any item is fit for a particular use. We strongly recommend attending the previews if available on any and all auctions. All bids are legally binding and enforceable in Ontario, Canada. BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. REMOVAL : All items are sold in place. Buyers are responsible to remove items in a good workmanlike manner. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must be bring any and all tools, equipment and labour required to disconnect and remove any items you purchase. We will only have security onsite that will not assist in any way with removal. Please plan ahead and come prepared. Any items not removed by the times shown will be deemed abandoned regardless of the price. WINNING NOTIFICATION & INVOICING: All winning bidders will be sent an e-mail invoice the day following the auction's closing. If you do not receive an invoice please check your junk mail. Even if you do not receive an invoice, you are still responsible for payment and pick up as stated in the auction. You can verify winning bids by logging into your account after the auction closes and checking each lot. If the lot says "Status", you have won. If it says "Outbid" you have not won. PICKUPS & REMOVALS: Dates and times for pickup will be posted on our website. We do not ship. Do not bid if you are unable to have your items picked up. Any item not picked up during the posted pickup times will be considered an abandoned item. Items are sold as is, where is, with all faults. If you abandon an item, your credit card will be charged a 25% restocking fee. CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an 'as is, where is' basis, with all faults. No responsibility is assumed by Drop The Hammer Auction Services or the seller for any errors or omissions. All items are sold AS IS, however Drop The Hammer Auction Services may return an item at our discretion if there is an error in the listing. To be considered for a return, customers must email sales@dropthehammer.ca WITHIN 24 HRS of picking up the item, describing the reason for requesting the return. CREDIT: By allowing you to bid we are extending you credit with the condition that you agree to pick up and pay for your items during the times posted using the payment terms specified. Failure to do so is a breach of the credit terms we have entered and can result in negative credit reporting and collections. By registering, you give Drop The Hammer Auction Services permission to charge the credit card you gave when registering as per the payment terms stated within the auction. We experience real costs when a customer fails to pick up their items as per the agreement and accordingly will pursue the terms of the agreement. Bids are not revocable and legally binding agreements between the seller and the buyer. SITE OUTAGE: In the event of a outage that affects bidding at any time during the closing on a sale, Drop The Hammer Auction Services at our discretion may extend the auction for a period of up to 24 hours. This decision will be made based on the severity of the outage. This is an extremely rare occurrence but in the event that it happens we need to be fair to all bidders (including those who may not have been able to bid) as well as our consignors. CLAIMS: No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults. PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. BUYERS: The BUYER expressly agrees to indemnify and save Drop The Hammer Auction Services, the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of Drop The Hammer Auction Services or anyone acting in his/her behalf in connection with or arising out of auction. All bidders/buyers must be of legal age. RESERVE: Seldom are items sold with Reserve. If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', you will be required to pay a minimum amount in order to win the item. AUCTION RECORDS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records. SOFT CLOSE: Items close at regular intervals. All bids made in the last minute of the auction will force an item to stay open for an additional 4 minutes. This will continue until all bidding has ceased. STRATEGY: Bidding is similar to Ebay type auctions, we recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis, with all faults. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. Items approved for a refund are returned at the buyers expense. IT IS THE BUYERS RESPONSIBILITY TO CHECK THEIR ITEMS BEFORE LEAVING THE PARKING LOT. LIMITATION OF LIABILITY You expressly understand and agree that Drop The Hammer Auction Services and it's Consignors shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sebae has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. By bidding you are acknowledging agreement with the terms above. Do not bid unless you agree to all of these terms.
